You (“User”) acknowledge and agree to be legally bound by the terms and conditions as stated herein below. The User is expected that he/ she/ it understands, agrees and undertakes that he/ she/ it is free to not accept the Terms and Conditions herein and in such an event, the said User is advised to not use, submit or access this Website/Web-form/App in any manner. By filling up the data in input fields & clicking “I Agree”, you constitute an irrevocable acceptance to this Terms and Conditions in addition to our Privacy Policy, Disclaimer Policy and Cookie Policy. Minors under the age of 18 are strictly prohibited from registering as users of this Website and are not permitted to transact, access, or use the Website in any manner.

Data Use & Storage

By submitting personal data on the Website or through any communication with the Company’s authorized representatives, the User expressly consents to the collection, use, processing, and secure storage of such information, including any documents voluntarily submitted such as the AECB credit report, for a period of up to two (2) years from the date of submission. This data may be retained and used by the Company for purposes including eligibility assessments, product recommendations, coordination with financial institutions, and to offer future financial product options that may be relevant to the User.

Communication & Messaging Consent

By providing contact information and submitting the lead form on the Website, the User explicitly authorizes the Company, including its representatives, affiliates, and authorized service providers, to contact the User via phone calls, SMS, WhatsApp messages, and emails, for the purpose of facilitating the financial product(s) requested or recommended. Such communication may include updates, clarifications, document collection, eligibility discussions, and promotional messages relating to the Company’s offerings or those of its partners.

These communications may be sent even if the User’s contact number is registered under any national Do Not Disturb (DND), Do Not Call (DNC), or National Customer Preference Register (NCPR) lists. By submitting their information, the User consents to receive such messages and acknowledges that they are aware of their right to opt out.

Opt-Out, Grievance Redressal & Data Deletion

The User may, at any time, opt out of receiving promotional WhatsApp messages by replying with “STOP” to any message received from the Company or by sending a written request to support@testmycard.ae. with the subject line “Consent Revocation” to support@testmycard.ae.

For any concerns related to communication, data processing, or misuse, the User may submit a grievance to the same email address. The Company will make reasonable efforts to acknowledge and respond to such grievances in accordance with applicable laws and internal policies.

The User also has the right to request the deletion of their personal data collected and stored by the Company. To initiate a deletion request, the User must send an email with the subject line “Data Deletion Request” to support@testmycard.ae . Upon verification of the request, the Company shall process the deletion of such data within fifteen (15) business days, subject to any legal or regulatory retention obligations under UAE law.

Authorization and Indemnity

The User hereby authorizes the Company’s authorized representatives, including but not limited to its employees, agents, partners, associates, or subsidiaries, to act on the User’s behalf for the purpose of processing financial product applications based on the information and documents submitted by the User.

The User agrees that they are solely responsible for the accuracy and completeness of the information and documentation provided through the Website or to any representative of the Company. The User shall indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, agents, or representatives from any third-party claims, liabilities, or proceedings arising from any misrepresentation, incorrect information, or omission on the part of the User.

Consent via Offline Sharing

Any document or personal information voluntarily shared by the User with the Company’s representatives, including via WhatsApp, email, or other permitted channels, shall be deemed to constitute the User’s informed and explicit consent for the Company to use and forward such information to its associated banks or financial institutions for the purpose of fulfilling the User’s selected financial product request.

Limitation of Liability

The Company shall not be liable for any unauthorized access, data misuse, or service issues arising from third-party platforms including WhatsApp or email providers, provided that the Company has taken reasonable security measures and has shared data only as per the User’s consent and this Policy. The Company is also not liable for any consequences arising out of service interruptions, delays, or errors attributable to external platforms beyond its control.

The Company does not guarantee or assure the approval, issuance, or disbursal of any financial product or service listed on the Website. The final decision regarding approval or rejection lies solely with the respective financial institution, and the Company shall not be responsible for any delay, denial, or change in terms resulting from the financial institution’s internal policies, eligibility criteria, or discretion.

Updates to Terms & Conditions

The Company reserves the right to amend, update, or modify these Terms & Conditions at any time, at its sole discretion and in accordance with applicable laws. Any such revised Terms shall be made available on the Website and shall become effective immediately upon publication. By ticking the consent checkbox prior to submitting their details, the User confirms that they have read, understood, and agreed to the most recent version of the Terms & Conditions, including any future modifications. Continued use of the Website shall be deemed acceptance of the updated Terms. The Company is not obligated to provide individual notice of such changes to Users. Users are encouraged to review the Terms & Conditions periodically to remain informed of any updates.

Compliance with Legal Obligations and Platform Policies

The Company processes personal information in accordance with applicable laws of the United Arab Emirates, including the Federal Decree Law No. 45 of 2021 on the Protection of Personal Data (PDPL). Where the Company interacts with Users through third-party platforms such as WhatsApp or other Meta products, it complies with Meta’s Business and Messaging Policies, including requirements relating to user consent, data transparency, and opt-out mechanisms.
